About these terms
These terms apply to the Gather app and its related services, provided by Silicon Infotech (“we”, “us”). Gather lets you create private groups and share photos and videos with the people you invite. By creating an account or using Gather you agree to these terms and to our Privacy policy. If you do not agree, please do not use Gather.
Who can use Gather
You must be at least 13 years old, or older if the law where you live requires a higher age to use a service like Gather without a parent’s consent. Gather is not designed for children under 13 and we do not knowingly allow them to sign up. You must give accurate information when you create your account.
Your account
You are responsible for what happens on your account and for keeping your sign-in details safe. Tell us straight away at iamdrb.tech.3@gmail.com if you think someone else has accessed it. One person per account: do not share or sell accounts.
Your content
You own the photos and videos you upload. You give us a limited, worldwide, non-exclusive, royalty-free licence to store, copy, resize, process and display them only to run Gather: to show them to the members of the groups you share them with and to keep them safe. This licence ends when the content is deleted, except for copies in short-lived backups. Only upload content you have the right to share, and only share photos of other people if they are happy for you to do so.
Content and conduct rules
Gather has zero tolerance for objectionable content and abusive behaviour. You must not upload or share: sexual content involving minors or anything that sexualises or endangers children; nudity or sexual content shared without the consent of everyone shown; content that promotes terrorism, violence or self-harm; hate speech or harassment; content that infringes someone else’s copyright, trademark or privacy; illegal content; malware or spam. You must not try to access groups or accounts you were not invited to, scrape the service, get around its limits or security, or use Gather for commercial purposes without our permission.
Child safety
We prohibit child sexual abuse and exploitation (CSAE) and child sexual abuse material (CSAM). When we find or are told about it we remove it, close the accounts involved, keep the evidence the law requires and report it to the relevant authorities, such as the National Center for Missing & Exploited Children (NCMEC) and local law enforcement. Report child-safety concerns in the app or to iamdrb.tech.3@gmail.com.
Reporting and moderation
You can report any photo or video from its viewer (••• › Report). We review reports and may remove content, remove people from groups, or suspend or close accounts that break these terms, with or without notice. Group admins can also delete content and remove members, and you can leave any group at any time. If you think we made a mistake, email us and we will take another look.
Groups and admins
The person who creates a group is its admin and can make other members admins. Admins can rename the group, change its cover, set an expiration date, remove members and delete any content in the group; only the creator can delete the group. Anyone with a group’s invite link, QR code or PIN can join it, so share them only with people you trust. Members can leave at any time and can delete their own uploads.
Plans and changes to the service
Gather is free to use and is supported by ads. You can choose to watch a reward ad to unlock some features for a limited time, such as uploading videos for 24 hours; a reward is only given for an ad watched to the end, and we may change or end rewards at any time. Some features, such as video uploads or extra storage, may also become part of a paid plan; we will tell you the price and terms before you pay anything. We may add, change or remove features, and we will give reasonable notice before removing anything that affects your content.
Deleting your account
You can delete your account at any time from Profile › Privacy & security › Delete account, or by emailing iamdrb.tech.3@gmail.com. This deletes your profile, everything you uploaded and the groups you created, as described in our Privacy policy. We may suspend or close accounts that break these terms or the law.
Disclaimers
We work hard to keep Gather running and your content safe, but the service is provided “as is” and “as available”. We cannot promise it will always be available or free of errors, so keep your own copies of photos that matter to you (use Save to device). Nothing in these terms limits rights you have under consumer law that cannot be limited.
Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, for loss of data, or for content other people upload. Our total liability to you for any claim about Gather is limited to the amount you paid us in the 12 months before the claim, or the equivalent of USD 50 if you paid nothing. We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law.
Changes to these terms
We may update these terms as Gather changes. We will show the new date at the top of this page and, for important changes, tell you in the app before they take effect. If you keep using Gather after that, you accept the updated terms.
